RENTAL CONTRACT

(year), is made by and between Crestview Apartments, hereinafter called management,
and _____________________________________________, hereinafter called tenant,

Management hereby rents to tenant and tenant hereby takes as tenancy under
management the dwelling accommodations located at ____________________________________________,
apt. no. _______, Logan, Utah.
Term: The contract term begins _____________________________ and ends _____________________________,
specifically covering: -fall semester, -spring semester, -summer.
Rent payment schedule: Tenant agrees to pay rent to management for the accommodations
in accordance with the following schedule:

If tenant elects to pay for the full school year in advance, the total amount
of $__________ is due July 1.
If tenant makes special arrangements with management to pay rent on a monthly
basis, the monthly rent amount is $__________. The last month's rent is payable
on __________________. The first month's rent is due before admittance to
the apartment; thereafter, rent is due on or before the ________ day of each
month.
Rent is due on or before the specified dates. A late fee of $15 will be charged
on the first day after the rent-due date. An additional $2 charge will be
added daily beyond the first late day until the amount due is fully paid.
Any tenant whose rent is more than 15 days overdue is subject to formal collection
procedures, or eviction, or both.
Security deposit: Tenant agrees to pay, prior to occupancy, a security deposit
of $__________, 25% of which is nonrefundable. The refundable portion of the
security deposit, less cost of damages attributed to tenant or guests, will
be returned by mail after the contract period and within 30 days following
receipt by management of a completed Check-out List and Deposit Refund Request
with forwarding address. The security deposit may not be applied to rent by
tenant. The security deposit may be used by management at its option to pay
costs and reduce losses incurred if tenant vacates the premises without suitable
replacements while still under contract, fails to pay rent as agreed, or causes
damages by action or negligence. Such costs and losses include, but are not
limited to: physical destruction of property, cleaning, advertising to find
a suitable replacement, fines, fees, and collection costs. If tenant must
vacate the premises due to tenant's violation of any of the provisions of
the contract, tenant will still be liable for all amounts stated in this contract.
Retention by management of any portion of this deposit to cover costs will
not relieve tenant of responsibility to pay all contracted amounts, including
rents, utilities, fees, and damages.
Utilities: Tenant agrees to pay for all utilities, including City of Logan
services, gas, telephone, and cable television.
Legal fees: In the event of failure of tenant to comply with any of the terms and conditions of this contract, wherein it becomes necessary for management to resort to legal action to enforce these provisions, tenant agrees to pay all reasonable attorney fees and court costs.
Conditions and rules: Tenant agrees to abide by the conditions and rules of occupancy of Crestview Apartments stated on both sides of this contract. Failure to abide by this contract is cause for eviction action by management.
I have read both sides of this rental contract and agree to be bound by all the terms and conditions contained in the contract.

Rental Contract-continued:
1. Application-A completed Application for Residence form and an application fee is required before an applicant will be considered for living in the Crestview Apartments. When a contract is signed, the management will hold the application fee as the security deposit for the term of the rental contract.
2. Assignment-Tenant may not assign, transfer, or sublet his or her interest in this contract to another person or permit other persons to occupy the premises without prior written consent of management. A fee of $50 may be charged to tenant for transferring the contract before the end of the contract period.
3. Moves-Management reserves the right to reassign student tenant to another apartment within the complex for the best use of the facilities, and tenant hereby agrees to such a move if management deems such to be necessary.
4. Disposition of abandoned personal property-On the date of termination, tenant must remove his or her personal property from the premises. The dwelling, equipment, and furniture must be left in good order, allowing for reasonable wear and tear. If tenant leaves personal property in the dwelling or on the premises after termination of occupancy, by notice or otherwise, such property if unclaimed 30 days after such termination will be subject to sale upon notice given for the length of time and in the manner provided by law for the sale of personal property on execution, together with a notice of the time and place of sale, mailed to the last know address of tenant or his or her parent or guardian as shown on the records. Management may retain out of the proceeds of sale the amount of the lien of any unpaid rent or charges which tenant owes, reasonable storage costs during the time said property remains in the possession of Crestview Apartments, and reasonable costs and charges of sale. Management will pay any excess of proceeds of sale to tenant or other persons entitled hereto on production of satisfactory evidence of the right of the claimant thereto.
5. Collection fees-In the event management finds it necessary to hire a collection agency to collect money owed, tenant agrees to pay up to an additional 40% of the amount owed to cover collection agency fees.
6. Housing regulations-Violation by tenant of city, state or national laws
will be deemed sufficient cause for immediate termination of tenancy by management.
Any disorderly conduct by tenant, which disturbs the peace, will be cause
for immediate termination of tenancy. Tenant agrees to abide by the following
rules and any other rules and regulation set up by management.
a. Gasoline, fireworks, firearms, and explosives are not permitted in the
apartments, or stored on the premises. Tenant's property may not be stored
in the furnace room.
b. Possession or consumption of alcoholic beverages, tobacco, or illegal drugs
on the premises is forbidden. Violation by either tenant or guests is basis
for immediate eviction and forfeiture of deposit.
c. Unlawful or immoral activity is not allowed.
d. Pets are not allowed on the premises.
e. Beds, vacuum cleaners, screens, fire extinguishers, smoke alarms, and all
other furnishings are to remain within the apartment at all times. Only management
is authorized to remove them. Neither tenant nor any guest may tamper with
screens, television antenna's electrical systems, or any other fixtures, including
removing batteries in smoke detectors.
f. Tenant and guests must remain off structure roofs and patio covers.
g. Only 60-watt light bulbs are allowed in light fixtures. Tenant agrees to
replace burned-out incandescent bulbs.
h. Waterbeds are not allowed without prior written approval of management.
i. Tenant must demonstrate respectful behavior of other in the building by
not causing disturbances, not playing loud music, not creating strong cooking
odors, etc.
j. Tenant must inform management of any occurrence of disturbing, destructive,
hazardous, unlawful, or suspicious activities on or near the premises; management
will enforce all rules and regulations according to its best judgment.
7. Inspections-Cleaning inspections will be made at the end of the contract
period or as scheduled and announced in writing by management. The management
reserves the right to enter the apartments at reasonable times to make repairs,
to conduct inspections, and to show the premises to prospective tenants, purchasers,
or appraisers. Tenant agrees to maintain order and cleanliness in the living
accommodations at all times. If housekeeping falls blow the management's standards,
or if tenant does not pass the cleaning inspections, cleaning will be done
by management; and $10 per hour (minimum fee: $20) for such services will
be charged to tenant(s) deemed responsible.
8. Key deposit-A key deposit is included in the security deposit. Loss of, or failure to return, the apartment key by checkout time will result in a charge of $15. Tenant may not duplicate keys.
9. Maintenance and alterations---Tenant accepts the premises as being in good order and repair, unless otherwise indicated on the Check-in Inspection Report. Tenant agrees to maintain the premises, including common areas and all furnishings therein, in a clean and sanitary condition, and to surrender the same at termination in as good condition as received, normal wear and tear excepted. Tenant may not paint or otherwise redecorate or make alterations to the premises. Tenant agrees to notify management immediately of any malfunction or necessary maintenance in writing or by telephone. Management will act with due diligence in making necessary repairs. Rent will not abate during such period.
10. Damages---Tenant is held responsible for all damages to furnishings and premises caused by negligence of tenant or guests. The replacement cost of all missing, broken, or damaged property of Crestview Apartments will be charged to tenant(s) responsible for such loss. Tenant hereby agrees to pay the amount necessary to replace said property. Expense or damage caused by stopping of waste pipes or overflow from bathtubs, showers, toilets, or washbasins must be paid by tenant.
11. Security-Crestview Apartments assumes no responsibility for loss or damage of property belonging to tenant or tenant's guests. Management recommends that tenant secures a renter's insurance policy.
12. Vehicles and parking-Tenant may not bring a vehicle larger than a pick-up truck on the premises. All vehicles must be currently licensed and in running condition. No driving or parking of motor vehicles is allowed on the lawns at any time. Tenant is expected to remove snow from and around his or her vehicle. Parking spaces are not for storage or automobile workshop areas. Cars may not be painted or receive lengthy repairs on the premises. Vehicles may not be parked on walkways. Trailers, boats, and campers may not be parked or stored on the premises without prior approval in writing from management. Parking permits may be issued on first-come basis if necessary to regulate parking.
13. Returned checks-A service fee of $15 will be charged for every returned check. A returned check may also result in a late fee as described on the front of this contract.
14. Default-Failure by tenant to perform any of the above requirements, or to satisfy any of these terms and conditions will be construed as a breach of contract, and will require tenant to remedy said failure or to vacate the premises within three days of failure to comply with the said requirement, term, or condition. Tenant will forfeit the security deposit if tenant is so forced to vacate the premises, and management may enter said premises and take and retain possession of the same and exclude tenant therefrom. Early departure or eviction shall not relieve tenant of financial responsibility stated in this contract.
15. No waiver-Nothing contained in this contract will be construed as waiving any of management's right under state laws governing this tenancy.
16. Enforceability-Should, for any reason, any portion or paragraph of this
contract be declared void, the balance of the contract will remain in full
force and effect.
